In no case are special categories of personal data processed in the sense of Article 9 of the GDPR.<\/p>\r\n<p><strong>Legal basis for the processing of personal data<\/strong><\/p>\r\n<p>The legal basis for the processing of personal data is consent. Palm Cloud SL is committed to obtaining the explicit and verifiable consent of the User for the processing of their personal data for one or more specific purposes.<\/p>\r\n<p>The User will have the right to withdraw their consent at any time. Withdrawing consent will be as easy as giving it. If the individual is under 14 years of age, the consent of their parents or legal guardians is required for the processing, and this will only be considered lawful to the extent that they have authorized it.<\/p>\r\n<p><strong>Secrecy and security of personal data<\/strong><\/p>\r\n<p>Palm Cloud SL is committed to adopting the necessary technical and organizational measures, at the appropriate level of security in relation to the risk of the collected data, in order to guarantee the security of personal data and prevent its destruction, loss, or accidental or unlawful alteration, or unauthorized communication or access to such data.<\/p>\r\n<p>However, since Palm Cloud SL cannot guarantee the invulnerability of the internet or the total absence of hackers or others who fraudulently access personal data, the Controller is committed to promptly notifying the User when a breach of the security of personal data occurs that is likely to result in a high risk to the rights and freedoms of individuals. In accordance with Article 4 of the GDPR, a breach of the security of personal data is understood to mean any breach of security that leads to the accidental or unlawful destruction, loss, alteration, unauthorized disclosure or access to personal data transmitted, stored, or otherwise processed.<\/p>\r\n<p>Personal data will be treated as confidential by the Controller, who is committed to informing and ensuring through a legal or contractual obligation that such confidentiality is respected by its employees, associates, and anyone to whom the information becomes accessible.<\/p>\r\n<p><strong>Rights derived from the processing of personal data<\/strong><\/p>\r\n<p>The User has, regarding Palm Cloud SL and may therefore exercise the following rights recognized in the GDPR and Organic Law 3\/2018, of December 5, on the Protection of Personal Data and Guarantee of Digital Rights:<\/p>\r\n<ul>\r\n<li>Right of access: It is the right of the User to obtain confirmation of whether Palm Cloud SL is processing their personal data or not and, if so, to obtain information about their specific personal data and the processing that Palm Cloud SL has carried out or carries out, as well as, among other things, information available about the origin of such data and the recipients of the communications made or planned for them.<\/li>\r\n<li>Right of rectification: It is the right of the User to have their personal data modified if it is inaccurate or, given the purposes of the processing, incomplete.<\/li>\r\n<li>Right to erasure (&#8220;the right to be forgotten&#8221;): It is the right of the User, as long as current legislation does not establish otherwise, to obtain the erasure of their personal data when they are no longer necessary for the purposes for which they were collected or processed; the User has withdrawn their consent to the processing, and there is no other legal basis; the User opposes the processing and there is no other legitimate reason to continue it; the personal data has been processed unlawfully; the personal data must be deleted in compliance with a legal obligation; or the personal data has been obtained from the direct offer of information society services to a minor under 14 years of age. In addition to erasing the data, the Controller, taking into account the available technology and the cost of its implementation, must take reasonable measures to inform the controllers that are processing the personal data of the requester of the erasure of any link to that personal data.<\/li>\r\n<li>Right to restriction of processing: It is the right of the User to restrict the processing of their personal data. The User has the right to obtain the restriction of processing when they challenge the accuracy of their personal data; the processing is unlawful; the Controller no longer needs the personal data, but the User needs it to make claims; and when the User opposes the processing.<\/li>\r\n<li>Right to data portability: In the event that the processing is carried out by automated means, the User will have the right to receive their personal data from the Controller in a structured, common and machine-readable format, and to transmit it to another controller.
